1. ACCEPTANCE OF THE TERMS
Welcome to Marketing de Bolsillo. These Terms and Conditions of Service (hereinafter, the “Terms”) constitute a legally binding agreement between you (the “Client” or “User”) and HUBMYPYME SAS (Tax ID 901708061), located at Calle 161 54 10, Bogotá D.C., Colombia (hereinafter “Marketing de Bolsillo,” “we,” “the Agency,” or “the Company”).
By entering into a contract, accepting a commercial proposal, or using any of our services available at www.marketingdebolsillo.com (the “Services”), you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
2. DEFINITIONS
For the purposes of these Terms, the following definitions shall apply:
- Agency or Marketing de Bolsillo: HUBMYPYME SAS, operating under the Marketing de Bolsillo brand.
- Client or User: A natural person or legal entity that contracts the Marketing de Bolsillo Services.
- Services: Strategic marketing, digital marketing, design, trade marketing, and business training services offered by Marketing de Bolsillo.
- Project: Specific work commissioned by the Client, either on a one-time payment basis or through a monthly retainer.
- Proposal: A document that details the scope, deliverables, timeline, budget, and specific terms of each project.
- Deliverables: Specific products or results agreed upon in the Proposal (designs, campaigns, websites, strategies, reports, materials, etc.).
- Retainer: A continuous service plan with recurring monthly billing.
- One-Pay Project: A service model with a defined scope and a single payment (which may be divided into milestones).
- Pilot: Initial trial period for retainer-based projects, with a minimum duration of 3 months.
- Client Digital Assets: Accounts, profiles, domains, and data configured in the Client’s name (Google Ads, Meta Business, Analytics, CRM, hosting, etc.).
3. DESCRIPTION OF SERVICES
3.1 Purpose
Marketing de Bolsillo is a strategic marketing agency that offers comprehensive 360° services for companies seeking sustainable growth and commercial autonomy. Our services include:
A) Digital Marketing
- Design and development of corporate websites, landing pages, and e-commerce sites
- Professional social media management (strategy, content, community management)
- Digital advertising campaigns (Google Ads, Meta Ads, LinkedIn Ads)
- B2B and B2C Lead Generation and Qualification Strategy
- Configuration and implementation of CRM and automation tools
- Analytics Setup and Metrics Tracking
- SEO Optimization and Organic Search Engine Ranking
- Email marketing and automation
- Content Strategy and Content Marketing
B) Trade Marketing and Point-of-Purchase Materials
- Design and production of booths for trade shows and events
- Printed materials (brochures, catalogs, flyers, posters)
- Point-of-sale branding (signage, displays, POP materials)
- Packaging and Label Design
- Logistics coordination for retail promotions
C) Design and Branding
- Visual identity and logo design
- Brand Manual and Graphic Guidelines
- Corporate Presentation Design
- Publication design (reports, white papers, e-books)
- Sales and marketing materials
D) Strategic Consulting
- Digital Presence Assessment and Business Strategy
- Designing go-to-market strategies for new products
- Comprehensive 360° Campaign Planning
- Digital Marketing Audits and ROI Optimization
- Strategic guidance for sales teams
E) Business Training
- Training on digital marketing tools for internal teams
- Training in Digital Prospecting and Lead Generation
- Training in the use of CRM and sales tools
- Customized strategic workshops
3.2 Service Options
Marketing de Bolsillo offers its services in the following formats:
One-Pay Projects
- Scope defined and finalized in the Commercial Proposal
- Schedule with specific due dates
- Lump-sum payment (may be divided into milestones depending on the project)
- 3-month warranty after delivery
Monthly Retainers
- Ongoing services with recurring monthly billing
- Defined monthly scope (hours, deliverables, services included)
- Minimum commitment of 3 months (pilot period)
- Automatic month-to-month renewal after the trial period
- 1-month warranty after the contract ends
Hybrid Projects
- A combination of one-time deliverables and recurring services
- Specific terms defined in the Commercial Proposal
3.3 Ownership of Digital Assets
Fundamental Principle: All digital assets created or configured for the Client are the property of the Client from the moment of their creation.
Marketing de Bolsillo is committed to:
- Set up all accounts and platforms in the Client's name
- Grant the Customer full administrative access
- Do not retain any information or data about the customer once the business relationship has ended
- Facilitate the full transition of all assets upon the expiration of the contract
This includes, but is not limited to:
- Google Ads accounts, Meta Business Manager, LinkedIn Campaign Manager
- Google Analytics, Google Search Console, Google Tag Manager
- CRM accounts and automation tools
- Web hosting and domain names
- Email marketing accounts
- Lead and prospect databases
- Social media profiles
Exception: The Agency’s methodologies, internal processes, base templates, and know-how remain the intellectual property of Marketing de Bolsillo.
4. CONTRACTING AND COMMERCIAL PROPOSALS
4.1 Hiring Process
- Initial consultation: The client requests a call or a strategic meeting
- Diagnosis: Pocket Marketing analyzes the client's needs
- Commercial Proposal: A detailed proposal including the scope, timeline, and budget will be sent
- Acceptance: The Customer accepts the proposal by digital signature or email
- Down payment: The down payment is made according to the agreed terms
- Project Launch: "Marketing de Bolsillo" Begins Implementation
4.2 Commercial Proposal
Each Commercial Proposal includes:
- Detailed description of the project scope
- Specific deliverables and their characteristics
- Implementation schedule with key dates
- Number of reviews included
- Breakdown of total investment
- Payment Terms
- Project-specific terms
Once accepted by the Customer, the Commercial Proposal becomes an integral part of these Terms.
4.3 Changes to the Scope
Any change to the scope of the project must:
- Please submit your request in writing (via email)
- Be reviewed by Marketing de Bolsillo
- Generate an addendum to the Commercial Proposal with adjustments to the price and schedule
- To be formally accepted by the Client
These changes may affect:
- The total cost of the project
- Delivery dates
- Allocated resources
5. PAYMENT TERMS
5.1 Payment Structure
For One-Pay Projects:
- Deposit: 50% upon acceptance of the proposal
- Final payment: 50% upon final delivery and approval of deliverables
For larger-scale projects, payment may be divided into specific milestones as defined in the Commercial Proposal.
For Monthly Retainers:
- First month: Payment in advance at the start of service
- Subsequent months: Monthly billing in advance during the first 5 days of each month
- Minimum commitment: 3 months (pilot period)
5.2 Payment Methods
The following payment methods are accepted:
- Bank transfer or deposit
- PSE (Secure Online Payments)
- Credit or debit card
- Other previously coordinated media
5.3 Currency
All payments are made in Colombian pesos (COP) unless otherwise expressly stated in the Commercial Proposal.
5.4 Billing
- Marketing de Bolsillo issues electronic invoices in accordance with DIAN regulations
- Invoices include VAT in accordance with current Colombian law
- The Customer must provide complete and accurate billing information
5.5 Late Payments
In the event of late payments:
- 6 days past due: A reminder is sent by email
- 11 days past due: The project or service is suspended
- 16 days past due: Late payment interest is charged at the current statutory rate in Colombia
- 31 days past due: The contract is terminated and the delinquency is reported to credit bureaus in accordance with Colombian regulations
For monthly retainers, failure to pay on time results in:
- Immediate suspension of services after 5 days of delinquency
- Unable to reactivate active campaigns or services
- Reactivation penalty fee equal to 20% of the monthly fee
5.6 Customer Information
The Customer must provide:
- Information needed to complete the project within the agreed-upon deadlines
- Access to platforms as needed
- Approvals within the specified timeframes
- Clear feedback on deliverables
Important: Delays caused by a lack of information from the Customer DO NOT automatically extend the delivery dates or exempt the Customer from their payment obligations as set forth in the Commercial Proposal.
If the delay exceeds 15 calendar days, Marketing de Bolsillo reserves the right to:
- Reschedule the project with new dates
- Apply a rescheduling fee (20% of the total project cost)
- Terminate the contract and bill for the work performed to date
6. REVISIONS AND ADJUSTMENTS
6.1 Number of Revisions
Each deliverable includes up to 7 (seven) revisions or adjustments at no additional cost.
The reviews cover:
- Text editing, writing, and copywriting
- Color changes within the agreed-upon palette
- Minor modifications to images, photographs, or graphic elements
- Corrections of spelling or grammatical errors
- Formatting or style settings
6.2 Adjustments NOT Included
The following are NOT considered minor repairs and require a separate quote:
- Complete redesign of a previously approved deliverable
- Change in strategy or conceptual approach
- Substantial modification of a project's structure
- Addition of new deliverables not included in the scope
- Changes requested after formal handover and project closure
6.3 Review Process
- Marketing de Bolsillo submits the work for review
- The client reviews and submits consolidated written feedback
- Marketing de Bolsillo implements changes
- The process is repeated up to a maximum of 7 iterations
- After 7 revisions, any additional changes will be quoted separately
6.4 Final Approval
The Client must formally approve each deliverable by:
- Email confirming approval
- Signing of the handover document (for large projects)
- Express written consent
Important: Once a deliverable has been formally approved, no further revisions will be accepted without an additional charge.
7. INTELLECTUAL PROPERTY
7.1 Ownership of Deliverables
The Customer acquires full ownership and usage rights to all deliverables created specifically for their project upon:
- Pay 100% of the agreed-upon amount
- Receive formal handover and approval of all deliverables
This includes:
- Graphic design (logos, branding, advertising materials)
- Websites and Digital Development
- Content created (text, videos, photos)
- Documented strategies
- Customized training materials
- Databases created during the project
7.2 Pocket Marketing Property
The following remain the exclusive property of Marketing de Bolsillo:
- Internal methodologies and work processes
- Base templates and frameworks used
- The Agency's expertise and technical knowledge
- In-house proprietary tools
- The name “Marketing de Bolsillo” and its brand identity
7.3 Third-Party Licenses
For third-party elements used in the project (stock photos, fonts, plugins, etc.):
- Marketing de Bolsillo ensures that they are used with the appropriate licenses
- The Customer must comply with the terms of those licenses
- Marketing de Bolsillo is not liable for any subsequent misuse by the Customer
7.4 Portfolio and Case Studies
Marketing de Bolsillo reserves the right to:
- Include your work in your public portfolio
- List the customer as a business reference
- Create case studies (using anonymized data if necessary)
If the Client requires complete confidentiality, they must specify this in writing before the project begins.
8. WARRANTIES AND POST-DELIVERY SUPPORT
8.1 Warranty for One-Pay Projects
Marketing de Bolsillo offers a 3-month warranty starting from the date of final delivery, which covers:
- Correction of technical errors attributable to Marketing de Bolsillo
- Bugs or glitches in web development
- Minor adjustments resulting from errors in the original implementation
- Basic technical support via email
Does NOT cover:
- New features or deliverables
- Third-party updates (WordPress, plugins, APIs)
- Damage caused by the Customer or third parties
- Changes requested after formal approval
8.2 Warranty for Monthly Retainers
Retainer clients are covered by a 3-month warranty following the formal termination of the contract, which includes:
- Technical support for completed configurations
- Access to documentation and training materials
- Basic Questions About Process Continuity
8.3 Technical Support
By category:
One-Pay Projects:
- Email support (hola@marketingdebolsillo.com)
- Response time: 48 business hours
Monthly Retainers (Active):
- Email support
- Support via WhatsApp (+57 313 255 33 03)
- Response time: 24 business hours (email), 4 business hours (WhatsApp for urgent matters)
Business hours: Monday through Friday, 9:00 AM – 6:00 PM (GMT-5, Colombia time)
9. CANCELLATION AND TERMINATION
9.1 Cancellation by the Customer – One-Pay Projects
If the Client decides to cancel a project before its completion:
Work performed:
- 100% of the work completed and delivered up to the date of cancellation will be charged
- All completed milestones and deliverables are submitted
Cancellation fee:
- An additional 15% of the total project cost will be charged as a penalty
- This penalty covers administrative costs, lost opportunities, and committed resources
Refund:
- If an advance payment has been made, the calculation is: (Advance payment) – (Work performed + Penalty)
- If the result is negative, the Customer must pay the outstanding balance
- If the result is positive, the refund will be issued within 30 calendar days
Example:
- Project worth 10,000,000 COP
- The customer paid a 50% deposit = $5,000,000 COP
- Cancel when 30% of the work has been completed = $3,000,000 COP
- 15% penalty = 1,500,000 COP
- Total amount due = $3,000,000 + $1,500,000 = $4,500,000 COP
- The customer has already paid 5,000,000 COP
9.2 Cancellation by the Client – Monthly Retainers
For monthly retainers:
During the pilot period (first 3 months):
- Written notice must be given 30 days in advance
- The full amount for the current month is charged (no prorated refund)
- A 15% penalty is charged on the monthly amount
After the pilot phase:
- You can cancel up to 30 days in advance
- There is NO cancellation fee
- The full amount for the current month is charged
9.3 Cancellation by Marketing de Bolsillo
Marketing de Bolsillo may terminate the contract immediately if:
- The customer is more than 30 days past due
- The Customer uses the deliverables for illegal activities
- The Customer seriously or repeatedly violates these Terms
- The Customer provides false or fraudulent information
- There is abusive or disrespectful behavior toward the Agency's staff
In these cases:
- We charge for all work performed to date
- A 15% penalty will be applied if Marketing de Bolsillo deems it appropriate
- There is no obligation to reimburse
9.4 Transfer of Assets upon Completion
Upon termination of the business relationship, Marketing de Bolsillo:
- Deliver all of the Client's source files and assets
- Fully transfer administrative access
- Provides documentation of the configurations made
- Assist with the transition to the new provider if the customer requests it
Deadline: No later than 15 business days after the formal completion of the project and full payment of outstanding invoices.
10. LIABILITY AND LIMITATIONS
10.1 Responsibilities of Marketing de Bolsillo
The Agency undertakes to:
- Provide services with professionalism and quality
- Meet the agreed-upon deadlines (subject to the timely receipt of information from the Client)
- Maintain the confidentiality of the Client's information
- Set up digital assets in the Client's name
- Provide training as agreed upon for each project
- Communicate transparently and in clear Spanish
10.2 Customer Responsibilities
The Customer agrees to:
- Pay on time in accordance with the agreed terms
- Provide complete, accurate, and timely information
- Approve or reject deliverables within a reasonable timeframe
- Respect the intellectual property rights of third parties
- Comply with applicable laws and regulations when using the services
- Maintain respectful communication with the Bolsillo Marketing team
10.3 Limitation of Liability
Marketing de Bolsillo is not responsible for:
- Specific business results (sales, conversions) are not expressly guaranteed
- Changes to algorithms on third-party platforms (Google, Meta, etc.)
- Suspension of advertising accounts due to third-party policies
- Data loss caused by the Customer or third parties
- Outages of third-party services (hosting, platforms, APIs)
- Misuse of deliverables by the Client
- Infringement of third-party rights due to content provided by the Customer
- Indirect, incidental, or consequential damages
10.4 Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS."
Pocket Marketing does NOT guarantee:
- Specific sales results or viral reach
- Specified conversion or engagement rates
- Organic search rankings for specific time frames
- Ad Campaign Performance
- Results that depend on external factors beyond the Agency's control
What we DO guarantee:
- Professional execution in accordance with industry best practices
- Compliance with the scope defined in the Commercial Proposal
- Transparency in processes and results
- Training and knowledge transfer
10.5 Indemnification
The Customer agrees to indemnify and hold harmless Marketing de Bolsillo for:
- Claims by third parties arising from content provided by the Customer
- Infringement of third-party intellectual property rights
- Unauthorized use of services or deliverables
- Breach of these Terms by the Customer
11. CONFIDENTIALITY AND DATA PROTECTION
11.1 Confidentiality
Both parties agree to:
- Keep all sensitive information confidential
- Do not disclose confidential information to third parties without authorization
- Use confidential information solely for the purposes of the project
The following is considered confidential information:
- Sales and Marketing Strategies
- Financial data
- Information on customers and prospects
- Internal, non-public processes
- Any information marked as "confidential"
Exception: Information that is already public or that must be disclosed by law is not considered confidential.
11.2 Protection of Personal Data
The processing of personal data is governed by Law 1581 of 2012 and applicable Colombian regulations.
Pocket Marketing as a Manager:
- We process the Customer's personal data in accordance with our Privacy Policy
- Implement appropriate security measures
- We do not sell or share personal data with third parties without consent
Customer as Data Controller:
- You are responsible for obtaining the necessary authorizations for any third-party data you provide
- You must comply with data protection regulations in your campaigns
- Marketing de Bolsillo acts as a data processor when it processes data at the Client’s request

12. TRAINING AND KNOWLEDGE TRANSFER
12.1 Training Philosophy
Pocket Marketing stands out for its "learn-as-you-go" approach:
- Each project includes training components
- We aim to help the client develop strategic autonomy
- We document processes so that the internal team can carry them forward
12.2 Included Training
According to the proposal, the following may be included:
- Onboarding sessions for configured tools
- Training on the use of platforms (Google Ads, Meta Business, CRM)
- Workshops on interpreting metrics and KPIs
- Training in digital prospecting processes
- Process documentation and playbooks
12.3 Additional Training
The Customer may purchase additional business training:
- Customized workshops for internal teams
- Training focused on specific tools
- One-time strategic consulting
- Mentoring sessions for sales teams
These are priced separately based on scope and duration.
13. FORCE MAJEURE
Neither party shall be liable for any failure to perform caused by events of force majeure, including:
- Natural disasters
- Wars, civil conflicts, or terrorism
- Pandemics or public health emergencies
- Major digital infrastructure outages (internet outages, cloud service outages)
- Regulatory changes that make enforcement impossible
- Any other event beyond the reasonable control of the parties
In the event of force majeure:
- The other party is notified immediately
- The affected obligations are temporarily suspended
- An alternative solution is being sought in good faith
- If the situation continues for more than 60 days, either party may terminate the contract without penalty
14. CHANGES TO THE TERMS
14.1 Right to Amend
Marketing de Bolsillo reserves the right to modify these Terms at any time.
14.2 Notification of Changes
Changes will be notified:
- The updated version is available at www.marketingdebolsillo.com/terminos
- Sending emails to active customers (for material changes)
- 30 days' notice for substantial changes
14.3 Acceptance of Changes
For current contracts:
- The new Terms apply to renewals and new projects
- Projects currently underway continue to be governed by the terms in effect at the time of contracting
- The Customer may cancel if they do not accept the new Terms (subject to cancellation provisions)
15. GENERAL PROVISIONS
15.1 Entire Agreement
These Terms, together with each accepted Commercial Proposal and the Privacy Policy, constitute the entire agreement between the parties and supersede any prior oral or written agreements.
15.2 Severability
If any provision of these Terms is held to be invalid or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect.
15.3 Notifications
All official notifications must be sent to:
For the Customer: To the email address provided in the Commercial Proposal
For Marketing de Bolsillo: hola@marketingdebolsillo.com
Notifications are deemed to have been received:
- Email: Immediately upon submission (if during business hours) or the next business day
- WhatsApp: At the time of read receipt (for non-official communications only)
15.4 Assignment
The Customer may not assign its rights or obligations under these Terms without the prior written consent of Marketing de Bolsillo.
Marketing de Bolsillo may assign this contract in the event of:
- Merger, acquisition, or sale of company assets
- Corporate restructuring
15.5 Relationship Between the Parties
Marketing de Bolsillo acts as an independent contractor. Nothing in these Terms creates a relationship of:
- Company or joint venture
- Employer-employee
- Lead Agent
- Franchisor-franchisee
15.6 Waiver
Failure to exercise any right under these Terms does not constitute a waiver of such right.
16. GOVERNING LAW AND DISPUTE RESOLUTION
16.1 Governing Law
These Terms are governed by the laws of the Republic of Colombia, specifically:
- Civil Code and Commercial Code
- Law No. 1581 of 2012 (Personal Data Protection)
- Law No. 527 of 1999 (Electronic Commerce)
- Law 1480 of 2011 (Consumer Protection Act)
- Other applicable regulations
16.2 Dispute Resolution
In the event of a dispute, the parties shall follow the following step-by-step process:
Step 1 – Direct Negotiation (30 days) The parties shall attempt to resolve any dispute amicably through direct communication in good faith.
Step 2 – Mediation (30 days) If direct negotiations are unsuccessful, the parties will seek mediation through a recognized conciliation center in Bogotá, D.C.
Step 3 – Arbitration If mediation fails to resolve the dispute, it shall be submitted to arbitration at the Arbitration and Conciliation Center of the Bogotá Chamber of Commerce under the following conditions:
- Arbitration in Law
- One (1) referee
- Language: Spanish
- Headquarters: Bogotá, Colombia
Step 4 – Ordinary Jurisdiction For matters that cannot be arbitrated by law, the parties submit to the exclusive jurisdiction of the competent courts of Bogotá, D.C., Colombia.
16.3 Consumer Complaints
Consumers residing in Colombia have the right to file complaints and claims with:
Superintendency of Industry and Commerce (SIC)
- Website: www.sic.gov.co
- According to the Consumer Protection Act (Law 1480 of 2011)

ACCEPTANCE
By accepting a Commercial Proposal, signing a contract, or beginning to use the Services, you acknowledge that:

✅ You agree to be legally bound by these Terms
✅ Has the legal authority to enter into contracts on their own behalf or on behalf of their company
✅ Please understand that Marketing de Bolsillo does not guarantee specific business results, but it does guarantee professional and transparent service
✅ Understand the policy on revisions, cancellations, and guarantees
✅ Please note that all digital assets created will be owned by the Customer and will be registered in their name
✅ Agrees to pay on time in accordance with the agreed terms
✅ Will provide the necessary information within the required timeframes to ensure the project is carried out properly
